How to change Cart and Calatoge rule

There is a catalog rule:

• -30% for one category

There is a cart rule:

• from 3 pieces of goods of any category -38%

 

If the rule is triggered in the cart and there is a discount item in it, then a very large discount is obtained.

I need that, when the rule of the basket is triggered from 3x, the commodity is counted as a commodity without a discount.

I tried to learn how the Cart.php (ps 1.6) class works and it seemed to me that I had to change the behavior of several functions. I think there is a solution more beautiful.

Tell me how to solve this problem.
