Color picker disable out of stock color

Hi everyone,

 

      I installed a color picker module so customers can select colors from the product list.

When a color  goes out of stock, it disappears from the color picker in the product page, but it doesnt from the one in the product list....

 

My version is 1.5.5.0

 

Any idea of why? I think its a code issue... Please help
